thought people ripped off by Macomber would appreciate this article from the Racine Journal Times Web site archives posted January 28, 1994. Seems our boy has a long history of fraudulent occupations: IMPOSTER ACCUSED IN NEW RACKET Twice found guilty of practicing optometry without a license, David Macomber now stands accused of setting his sights on a new racket in the mortgage business. Macomber, 31, formerly of 137 Water's Edge Circle in Burlington, was charged in Racine County Circuit Court Thursday with bilking hopeful homeowners out of thousands of dollars during a six-month period beginning last February. Most of the alleged offenses occurred while Macomber was free on bond in connection with a Milwaukee County fraud case against him, and on probation for a Racine County case. He's now back behind bars. It seems Macomber - who once worked giving eye exams and prescribing lenses without a license at Avenue Optical, 3320 Washington Ave.,- decided to try his hand at the mortgage-lending business, authorities said. Macomber convinced officials at Kapp Financial Group in Wauwatosa to let him set up a mortgage department. He joined their firm as an associate and began training others in how to secure mortgage refinancing loans, the complaint said. He also established a business called Statewide Mortgage Group and allegedly told the Kapps and other associates that all mortgages should come through him. Mortgage applications were to be processed through Macomber and clients were told to make out checks to his company. This time, however, he had the required loan solicitor's license from the state of Wisconsin. It wasn't until later, according to the criminal complaint, that authorities learned the license had been fraudulently obtained. Macomber had denied having any prior felony or misdemeanor convictions when he filled out and signed the application on Feb. 11, 1993. The form was witnessed and stamped by a notary public. Just a week earlier, Macomber was convicted of felony theft by fraud and he was still on probation. He also has two misdemeanor convictions for practicing optometry without a license. Authorities said Macomber took money for home appraisals, credit checks and fees for other paperwork associated with mortgage-lending. But none of the money went to help people purchase homes. Instead, the complaint said, Macomber used more than $3,000 deposited in the Statewide Mortgage account at a Racine bank to pay off credit card bills, medical bills and even to purchase a $275 car from his father. But things began to fall apart last June. First, a McFarland man who had attended classes taught by Macomber at Kapp Financial got suspicious when a $300 check was never forwarded to another financial company as promised by Macomber. Then the McFarland man discovered Macomber was in jail. Meanwhile, Macomber got out of jail and continued to ply his illegal trade for at least another month, according to the complaint. He even taught at least five sessions of a mortgage refinancing class to business people on Thursday nights in Sun Prairie. He allegedly told them that they should submit any mortgages they sold through his company. By September, things began to unravel as investigators from the state Department of Justice began to put it all together. Macomber, the complaint said, admitted to an investigator that he had done some of the things of which he's accused.. But at least one person, a woman from Muskego, got her money back. On Nov. 19, the woman called a justice department investigator to report she had received in the mail a check for $1,635 drawn on the Statewide Mortgage account. The check was signed by a woman identified as Macomber's girlfriend. If convicted of the four felonies and six misdemeanors, Macomber faces up to 59 years in jail and fines up to $100,000.

Once a thief...always a thief... New complaints send man back to court By | Posted: Saturday, April 27, 1991 12:00 am | He is allegedly practicing optometry without a license By Gary Metro Racine Journal Times A man accused of practicing optometry in Racine without a license earlier this week was brought back to court Friday after more clients complained to the Racine County district attorney's office. David Macomber is accused of examining people and prescribing lenses at Avenue Optical, 3320 Washington Ave., in defiance of a court order against his working as an optometrist. He also is suspected of providing people with medication for eye conditions. Macomber's practice, as alleged, could destroy the vision of the eyeglass and contact lens customers who have used his services, according to Racine County Assistant District Attorney Sharon Riek, who asked the court to set a higher bond for his release and said additional charges may be coming. "You can cause permanent eye damage if you prescribe contact lenses for someone who shouldn't wear contact lenses. Poorly fit contact lenses can cause permanent eye damage," Riek said Friday. Macomber's alleged practice of prescribing medication could delay some people from getting proper medical attention for a debilitating eye disease, she added. In response to Riek's request Court Commissioner James Drummond not only boosted bond for Macomber's release, he ordered him out of business. "You are not to conduct any optical business in Racine County without the express permission of the court," Drummond said. "I want the phone dead and I want the sign out. You are not in business in Racine County." Riek filed charges against Macomber, 29, address unknown earlier in the week. But new allegations made against Macomber since he was accused of practicing optometry without a license, theft by fraud and bail jumping brought him back to court. "I have received eight addition complaints," Riek said. "Those are the complaints that merit additional investigation by our office … We're only investigating the best cases." Because of the new allegations, Drummond added a $500 signature bond to the $500 cash bond posted by Macomber earlier this week. This is not the first time Macomber has faced such charges. He paid a $200 fine June 14 for an earlier conviction of practicing optometry without a license. In the current proceedings against Macomber, he is accused of examining, prescribing and providing contact lenses for a Racine man. Police said the man got his lenses March 1, but one of the lenses was chipped and the man couldn't see from the other one. Police said the man paid $130 and never received a satisfactory pair of contact lenses. Macomber also is charged with bail jumping for allegedly refusing to report for for fingerprints and photographs ordered in an earlier criminal prosecution.

Every time we called it was the same story that DMV was holding it up. Guess what we called DMV and no license. We then called the state but to recoup her money she would have to come back to the US and take him to court. He is a con....

Anyway they actually said told me something that paralells some of the articles here... "well your kid got lessons did you really expect to get something for nothing?" This comment really confused me. Then I realized the extent of my loss. I paid $540 and he promised a $350 rebate if my kid passed on the first try. Which he did. It all made sense to me at the time. $540 all inclusive no matter how long it takes. If it goes easier then after the rebate it's about average with the other driving schools. It really pisses me off that CG thinks that this is a victimless crime. "Well you actually received the services that you paid for."

I trained to be a driver's education instructor under Dave Macomber at Destination Driving School. I want you to know that there was a time when Dave operated an excellent driving school. His X-wife, who holds a key position at another business in the area; would work days and also work for Dave evenings to make sure his business flourished. His X-wife, her family and close friends of Dave's had no idea what Dave was really up to behind the scenes. While we all trusted him to be a good husband, family member, friend, neighbor and business owner; he was secretly involved in activities that would destroy his marriage and other relationships. Bankers, lawyers and other busissmen are stunned by some of his recent behaivor. I am sickened by it. The State of Wisconsin is to be commended for showing Dave that breaking the law is unexceptable. They maintain that there is still a place in our society for integrity and honesty. Other angencies involved in his discipline have yet to impress me. How can a man take so much away from people (especially his former wife)and continue to walk around free with the rest of us hard working honest citizens? "JUSTICE" I certainly hope that after all that has been invested by so many people...there will soon be proper, lawful and fair justice in this matter. I don't usually participate in this type of media; but I thought a few plain facts might be refreshing. "An Honest Taxpayer"

      A good person

Over the recent years, I’ve been fortunate to come to know Dave as a very different person than many of you have made him out to be. Each and every one of you should be ashamed of yourselves! Money issues can bring out a very ugly side of people, and you all are very, very ugly….not only my eyes, but in the eyes of the ONE that matters most. Not that you need to know, but Dave has had an extremely difficult past year, both professionally and personally. You all need to get your facts straight before plastering cruel and hurtful remarks about someone over the internet. It’s clear to see that you all are very angry and unhappy people that have nothing better to do than to knock someone down….someone that has only gone out of their way to accommodate and service people/students like you over the last 10 years. Dave is an honest, caring, personable guy and has taken each one of these attacks very personally. I’m sure that if Dave were to pull each one of your child’s Driving Record file, it would reflect how Dave has gone over and beyond the call of duty to accommodate YOU or your child’s every changing family schedule or personal situation. Dave’s ultimate goal has always been to teach good, safe driving skills to new drivers. Dave not only truly enjoys working with each student (from teens through adults), in both classroom and behind-the-wheel, but also cares about each and every one of his students, and wants them to succeed, not only with his program, but as individuals in the community. He has gone out of his way to accommodate many different family situations and changes that have occurred DAILY in YOUR lives. After doing my research, and speaking with several parents around the community, I decided with Destination Driving School for my children’s driving instruction because of its 10 year reputation of providing both top quality service, and caring, compassionate and professional instructors……..…… NOT for the money rebate. You’ve all obviously chose to enroll your children for a completely different reason-----money. I, too, have not received my rebate in the mail yet, but what’s more important to me is knowing that my children have received excellent instruction in a fun learning environment, and are now safe & confident new drivers out on the roads today. We’ve all been affected in some unfortunate way by the downfall of the economy, and neither Destination Driving School nor Dave has been excluded from that affect. Due to the economy and a poor business decision, it’s been extremely difficult for the school to follow through, in a timely matter, its gracious commitment of a rebate back to the student. I say the STUDENT, not the parent, because it’s the STUDENT that’s entitled to the rebate. It’s easy for you all to hide behind a ‘screen name’ and criticize and make horrible remarks about this situation, verbal attacks on an individual, but if you were man/woman enough to post your real names, I can be certain that you are NOT all perfect individuals, and you, too have made poor decisions in the past, and your names appear in CCAP, too, for one reason or another. It’s a fact. But Dave IS a man of his word. I personally guarantee that each student will receive the rebate entitled to them, in the appropriate amount. Dave continues to issue rebates as funds slowly become available. It’s been a slow process, and he has already issued 10’s of thousands of dollars in rebates to this date. I know that Dave will survive this difficult time, and he will come out an even stronger, wiser, and better human being in the end…..the type of human being that only you nasty, selfish, and heartless individuals can only dream of ever being.

My daughter took the classroom instructions and all was good. Now for the driving portion nothing but trouble. She drove with them once and have been trying for the last 2 months to get more driving time. Can't get a hold of anyone. No one will call back. If we had to do it over again we would not go with this school. Very poor management and service.

my son and several of his friends were registered to attend the Berlin Class on Jan. 26, 2009 at the high school, when we arrived and went to the room found out it had been moved to somewhere on Main Street, that was really great on his part for not informing his students - of the move in location... I agree that you never can get in touch with him- maybe the DMV put a stop to his FRAUD GAME people can only hope.. get your kids hopes up for starting drivers ed and this happens- he really needs to be closed...some of my son's friends paid him up front - I just hopw they can get their money back..

They missed an appt with my son for a lesson, then came to pick him up a week and a half later when there was no lesson scheduled. I cannot reach anyone at the office. No answer, no answering machine, nothing but a ringing phone. I don't even know if they are still in business. I'd like to have my son at least finish his course!

i have not taken this course but many of my friends have. they were promised to get their money back and it's been almost a year now. someone should report this guy and take him to court. some people actually need the money back with the way the economy is. how can they say they'll refund your money and never give it back. some people might not have even taken the course if they knew they were gonna get stolen from.

Finally received a money order in the mail after pursuing Dave for weeks. It's been 5 months since my son received his license. The issue to me isn't whether the service was good or poor, it's business ethics. If you promote your business with promises, you should fulfill them. I'm a business owner and would never give a customer a run around. If you want your refund, you need to make a lot of noise. I caught Dave in the office, and he knew I meant business. His previous secretary told me " the squeaky wheel gets the grease around here." Dave would be better off paying people what he agreed to without all the hassles. It's not good for business to cause so much aggravation. Wonder why I was paid with a money order instead of business check?

This is very sad. Both my children went to Destination Driving. Both children received their license on the first try. I was impressed with that the school worked around our very busy schedule. Both kids were picked up from school during study hall which was a huge help. About the refund. If no refund is available, it confuses me why he would state there would be one. He has plenty of business and does not need to fraud people into using his service. I applied for the refund, but if it isn't available so be it! I would have paid for his service and only looked at the refund as a bonus. Thanks for 2 safe drivers.

Definately fraud...state DMV called me today and stated they've contacted Destination and told them to cease saying their is any "grant". State rep also said DMV has no prosecutorial powers and I would have to pursue the matter with police.

Have been waiting for refund since Sept. Was told it would be 8-10wks. Dave told my husband today he awards money back to some people. It goes on a case by case basis. I will be investigating further and take action if I do not get my refund for both of my children. Has anyone call the DMV?

Ditto the other comments about being a fraud. It's been 5 months and no refund. I'm going to the police to file a fraud charge.

Although when you can actually talk with Dave he is very nice (too nice? smooth?) he never returns your calls. He does not do what he says he will do. Customer service is poor. He avoids all messages re. the $350 refund claim. Says he'll get back to you but doesn't.

Just off the phone with the DMV - they verified there is NOT a grant or refund program for this business thru the state as is the claim of "Dave" the owner. If you would like to file a complaint with the DMV, the number is 1-608-264-7495.

The only reason I did not rate excellent is in regard to a scheduled appt and the instructor appeared 1/2 hr early. The appt was set for 8 am and the instructor appeared at 7:30 am. Other than that, everyone was pleasant to work with and I felt my child learned alot from taking this course.

cars are consistently late or early to pick you up for your btw practice. they once came an hour early for my brother when he went through it. my first time out with them when i had driven like twice ever, the instructor said we're going to do a mock driver's ed test. another driving instructor harrassed and teased us about anything and everything. i hated every single driver's ed lesson i had with destination driving school. i also took their classroom portion and felt the teaching was very ineffective. also a huge amount of scheduling problems for lessons!! and they never get back to you when you call them.

I am now in a drivers ed class with Dave M. (#3303). He is a great teacher and if some people are having trouble with something, he takes the time to help them! The best thing I like about Dave is that he pushes all of us in the class to do the work and I think that really helps! Thanks Dave!!
