Terms & Conditions
ONLINE ADULT DRIVER EDUCATION
DriversEd.com, hereafter referred to as the "COURSE PROVIDER", is certified by the Illinois Secretary of State’s Driver Services Department to offer an Illinois online Adult Driver Education course, hereafter referred to as the "COURSE".
ACCEPTANCE OF CONTRACT TERMS
The following are terms of a legal agreement between you, hereafter referred to as the "STUDENT" and the COURSE PROVIDER. By accessing, using, and/or browsing this site, the "STUDENT" acknowledges that HE/SHE has read, has understood, and agrees to be bound by the terms of this agreement:
The course tuition in the amount of will be charged to the STUDENT. This fee includes all required instructional materials and must be paid in full prior to course completion.
PLEASE NOTE: To take the course, STUDENT must be 18, 19 or 20 years of age. STUDENT must not have previously held a driver’s license or successfully completed an approved driver education course or the classroom portion of an approved driver education course.
The COURSE is composed of 6 hours of instruction. The STUDENT must complete 360 minutes of instruction and spend the minimum time required to participate in each section or the course. Following each of the instructional units, the STUDENT shall be required to successfully pass a content comprehension quiz, hereafter referred to as "SECTION QUIZ" and a final examination, at the end of the COURSE. If a STUDENT attempts to take a section quiz or the final examination without having spent the minimum time required for a section or the COURSE, the STUDENT will be returned to the place in the COURSE where the STUDENT last spent the minimum required time. Failure of two (2) or more content comprehension questions shall result in a section quiz failure, whereby the STUDENT must complete the section HE/SHE failed again.
The course will be available to the STUDENT online, 24 hours a day, 7 days a week. This availability may be affected by circumstances such as, but not limited to: system, site or connectivity failure over which the course owner has no control.
COURSE COMPLETION DATE
The Illinois Secretary of State’s Driver Services Department requires a mandatory completion of the COURSE within 30 days after commencement of instruction. Therefore, if the STUDENT fails to complete the COURSE within the time requirement, the course of instruction shall be terminated, the STUDENT’s account shall be locked and the STUDENT shall be deemed to have failed the COURSE. Where the account is locked, it can be reinstated only by the COURSE PROVIDER. No reinstatement fee will apply to reinstate the account, re-enroll and start the COURSE over from the beginning.
GRADING AND PROGRESS POLICY
STUDENT must complete a final examination at the end of the COURSE, which shall consist of 20 questions. The STUDENT agrees that HE/SHE may not be certified or given credit for the course unless they score 75% or higher on the final examination. Alternative testing techniques for students with reading, hearing or learning handicaps and policies for re-testing students who score less than 75% will be a) online review of course material; and b) online re-testing.
STUDENT may take the final exam two (2) times to achieve the 75% score. After a second failure, the STUDENT has failed the COURSE and HE/SHE must start the COURSE over from the beginning.
CERTIFICATE OF COMPLETION
The STUDENT agrees to complete all instructional sections of the curriculum in order to receive a completion certificate. The COURSE PROVIDER will only notify the Illinois Secretary of State’s Driver Services Department of course completion if a STUDENT has met all the requirements for course completion and has paid all tuition and fees payments in full to the COURSE PROVIDER.
After the Illinois Secretary of State’s Driver Services Department has been notified that the STUDENT has completed the COURSE, a Certificate of Completion will be issued. An electronic version of the Certificate of Completion will be made available to the STUDENT by the COURSE PROVIDER via the course dashboard. To view this document, the STUDENT must have Adobe Acrobat installed on HIS/HER system. The STUDENT must bring a printed version of the Certificate of Completion to an Illinois Secretary of State Driver Services Facility to obtain a license.
The STUDENT understands that for identity verification purposes, the COURSE PROVIDER may utilize the following methods for ensuring the identity of the COURSE participant:
- The STUDENT shall provide voice verification pattern at the start of the COURSE (hereafter referred to as the "initial voice pattern"). STUDENT will be required to pass a minimum of 6 voice verification tests throughout the course, during random intervals. STUDENT shall have 60 seconds to provide a voice pattern. If the STUDENT fails to provide a voice pattern, or to do so within 60 seconds, the STUDENT shall be returned to the place in the COURSE where the STUDENT last successfully passed a verification. A STUDENT who for a second time fails to provide a voice pattern, or to do so within 60 seconds, shall be prevented from completing the COURSE and shall be deemed to have failed the COURSE. The STUDENT must then start the COURSE over from the beginning.
If the voice pattern provided by the STUDENT does not match the initial voice pattern, the STUDENT shall be required to provide another voice pattern. If the second voice pattern does not match the initial voice pattern, the STUDENT shall be required to provide a third voice pattern. If the third voice pattern does not match the initial voice pattern, the STUDENT shall be prevented from completing the COURSE and shall be deemed to have failed the COURSE. The STUDENT must then start the COURSE over from the beginning.
The STUDENT agrees that HE/SHE, and not any other person, will study the material in its entirety and complete the section quizzes and the final examination. It is illegal to attempt to circumvent this COURSE or provide false information. If the COURSE PROVIDER discovers that the STUDENT has willfully misrepresented himself/herself or has cheated, the STUDENT will be stopped from taking the COURSE with no refund of the registration fees. In addition, the STUDENT may be prosecuted for perjury and other criminal acts which are punishable by law.
CANCELLATION AND REFUND POLICY
DriversEd.com will issue a full tuition refund:
- If the STUDENT has not completed the Illinois Adult Course and a Certificate of Completion has not been issued.
DriversEd.com will not issue refunds:
- If the STUDENT has completed the online course and a Certificate of Completion has been issued.
To request a refund, please contact us toll free at 877-877-2525. No refund shall be issued to a STUDENT for whom a course completion certificate has been issued by the Illinois Secretary of State’s Driver Services Department, nor shall a refund be issued to a STUDENT whose COURSE has been discontinued as a result of authentication failure.
HARDWARE AND SOFTWARE
The COURSE PROVIDER collects information from its users at several different points on the website. The COURSE PROVIDER will not use or sell this information to promote products or services unrelated to this course/product or in ways different from what is disclosed in the Privacy Statement. By agreeing to these terms and conditions, you are agreeing to the collection, use and disclosure of your personal information as described in the Privacy Statement.
After completion of the course, the COURSE PROVIDER may request information from STUDENT via surveys. Participation in these surveys is completely voluntary. The requested information typically asks the reason for choosing our site, how the STUDENT heard about our site, level of computer expertise, and means of connecting to the Internet.
Survey information will be used for purposes of monitoring or improving the use and satisfaction of our sites and for statistical purposes. We may also use your survey information for customer testimonial. You have a choice whether or not to have your survey information used for a testimonial. If you prefer, you can opt to have your responses kept out of our customer testimonials. By submitting the answers to the Survey, the STUDENT gives the COURSE PROVIDER permission to reprint, reproduce or use the answers for customer testimonial, under the following terms and conditions as listed below:
- The STUDENT acknowledges and agrees that the COURSE PROVIDER shall have the right to publish his answers, in whole or in part, in any format or media, whether now known or hereafter developed.
- The reprint, reproduction or use of the answers will be at the COURSE PROVIDER's discretion and without compensation;
- The STUDENT agrees to let the COURSE PROVIDER display the STUDENT'S answers with his/her first name, last initial and city/state;
- The COURSE PROVIDER 'S right to use the answers is perpetual and may be assigned;
- The STUDENT, and not someone else, composed and submitted the answers.
REPRESENTATIONS AND WARRANTIES
STUDENT represents and warrants that the user information and registration information provided by STUDENT is true and correct, and acknowledges that the truth and accuracy of such information is a material inducement to COURSE PROVIDER in permitting STUDENT to enroll in the course. STUDENT further acknowledges and agrees that any willful or intentional misrepresentation by STUDENT regarding such user information or registration information constitutes a breach of this agreement and of the representations and warranties by STUDENT as provided in this agreement, and may subject STUDENT to liability for damages incurred by COURSE PROVIDER as a result thereof, including but not limited to general, consequential, and punitive damages.
LIMITATION OF LIABILITY
STUDENT acknowledges and agrees that the liability of the COURSE PROVIDER and their agents and employees for any act, omission to act, or negligence on the part of COURSE PROVIDER and its agents and employees, is strictly limited to and shall not exceed the amount of the registration fee actually paid by STUDENT.
This agreement constitutes the entire agreement between the COURSE PROVIDER and the STUDENT, and any verbal assurances or promises not contained herein shall not bind the COURSE PROVIDER or the STUDENT.
If any provision of this agreement is found by a court of competent jurisdiction to be unenforceable, the remaining terms and conditions shall nevertheless be of full force and effect. STUDENT further acknowledges that any grievances not resolved by the COURSE PROVIDER: 283 4th St., Suite 301, Oakland, CA 94607, 877-877-2525 may be directed to the Illinois Secretary of State’s Driver Services Department: 2701 SOUTH DIRKSEN PARKWAY, SPRINGFIELD, IL 62723.
The COURSE PROVIDER may not sell, transfer, assign, exchange, trade, or otherwise dispose of any contract or part of the contract, agreement or obligation between the COURSE PROVIDER and any STUDENT, unless the COURSE PROVIDER has obtained the written consent of the STUDENT.
By clicking on "Agree" the STUDENT acknowledges that HE/SHE has read this entire Agreement, that HE/SHE fully understands it, and that HE/SHE agrees to be legally bound by it. The STUDENT further acknowledges that HE/SHE has been furnished with all the information on the SCHOOL tuition, schedule, cancellation and refund policy; as well as the COURSE PROVIDER regulations pertaining to grading policy and progress.
